UN Experts Accuse Israel of Genocide in Gaza, Urge Action

A team of independent experts from the United Nations’ Human Rights Council has determined that Israel is committing genocide in Gaza. The report, released on October 31, 2023, calls on the international community to intervene and take measures against those responsible for these actions.
The findings, outlined by the three-member commission, highlight the ongoing conflict between Israel and Hamas, which has resulted in the death of tens of thousands of individuals in Gaza. The report marks a significant escalation in accusations against the Israeli government, led by Prime Minister Benjamin Netanyahu, amid the ongoing hostilities that began after the October 7, 2023 attacks by Hamas.
In response to the report, Israel’s government has categorically rejected the accusations, labeling them as a “distorted and false” portrayal of the situation. The commission, formally known as the Commission of Inquiry on the Occupied Palestinian Territory and Israel, was established in 2019 to investigate alleged human rights violations in the region.

The report states that Israel has committed four of the five “genocidal acts” as defined by the 1948 Genocide Convention. According to the commission chair, Navi Pillay, there is a clear intent to destroy the Palestinian population in Gaza through actions that qualify as genocide. Pillay indicated that accountability lies with Israeli leaders at the highest levels, including Netanyahu, President Isaac Herzog, and former Defense Minister Yoav Gallant.
While the commission lacks the authority to take direct action against Israel, its findings could influence future legal proceedings at the International Criminal Court or the International Court of Justice. Pillay emphasized the necessity for the international community to respond, stating, “When clear signs and evidence of genocide emerge, the absence of action to stop it amounts to complicity.”
The commission’s conclusions follow extensive documentation of Israel’s military actions, which include a total siege of Gaza and the systematic destruction of essential services, particularly healthcare. The report points to the devastating humanitarian impact, including widespread starvation and the direct targeting of children.
Reactions and Global Context
Israel’s Foreign Ministry condemned the report, asserting that it was produced by individuals with a history of antisemitic statements and that it represents a “fake” narrative about Gaza. The sensitivity surrounding accusations of genocide is heightened in Israel, a nation founded in the aftermath of the Holocaust, where such allegations resonate deeply within its national identity.
The current UN High Commissioner for Human Rights, Volker Türk, has criticized Israel’s conduct during the conflict but has stopped short of labeling it as genocide. His office noted that only an international court can render a formal judgment on genocide, a process many critics argue could take years, during which civilian casualties continue to mount.
In a related development, the International Court of Justice is currently hearing a case filed by South Africa against Israel, further complicating the international legal landscape surrounding these accusations.
As the situation in Gaza remains dire, the report’s implications could provoke a reevaluation of international arms sales and diplomatic relations with Israel, as global leaders grapple with the findings and the pressing need for action to prevent further atrocities.
