Court Weighs Urgent Decision on High-Risk Accused Trevor Farley
UPDATE: A critical court hearing is underway regarding the mental health status of Trevor Farley, a man designated as “high-risk” after being found not criminally responsible for the 2021 killings of his parents and a violent attack on his former supervisor. The Manitoba Court of King’s Bench, led by Justice Ken Champagne, is evaluating whether to lift this rare designation, which significantly limits Farley’s access to community programs and family visits.
The hearing, which began on Monday, October 23, 2023, is set to continue into Friday, with immediate implications for Farley’s treatment at the Selkirk Mental Health Centre. During Tuesday’s session, James Wasio, the facility’s forensic director, outlined the facility’s conservative approach to Farley, who has been held in its highest-security area since December 2023. He stated that Farley is currently barred from receiving passes for community access or family visits due to his designation.
Wasio confirmed that while the high-risk label restricts some privileges, it does not entirely prevent Farley from earning more lenient conditions within the facility. He indicated that accommodations could potentially be made to allow Farley increased privileges, including unsupervised community access.
However, behavior concerns have been raised regarding Farley’s conduct at the facility. He reportedly encouraged other patients to avoid medication and has made unsettling comments regarding his case. Defense attorney Carley Mahoney challenged the lack of documentation surrounding these incidents, highlighting that staff were aware of Farley’s history of violence, including an attack on a nurse.
Prosecutor Erin Brown further scrutinized Farley’s self-representation, arguing that he presents an overly optimistic view of his prospects for rehabilitation and reintegration into society. “He seems to be painting a much rosier picture of what’s actually reality,” Brown stated. This assessment could play a crucial role in determining Farley’s future, as realistic expectations are essential for any potential discharge.
As the hearing unfolds, the stakes remain high for Farley and the community. The outcome could redefine his treatment path and influence how mental health cases are managed in Manitoba.
