CSRD Takes Legal Action Against Spa Hills Compost Facility
The Columbia Shuswap Regional District (CSRD) has filed legal proceedings against the Spa Hills Compost facility located at 2223 Yankee Flats Road. This action aims to ensure the facility complies with local zoning regulations. The decision follows a motion approved during an in-camera discussion at the CSRD’s regular meeting on September 18, 2023, which authorized staff to take necessary measures, including initiating legal action against the facility.
The CSRD’s move comes after the board rejected a rezoning application submitted by Spa Hills, which sought to expand its composting operations. The application aimed to increase the area used for composting and curing from 500 square metres to 23,725 square metres, thus aligning with the current operational scale. The board’s denial of this application reflects ongoing concerns raised by residents in nearby Silver Creek.
Community Concerns Drive Action
Residents living close to the Spa Hills facility have expressed significant concerns regarding its operations. Complaints submitted to the CSRD included excessive odours, waste processing exceeding permitted limits, and potential environmental impacts on groundwater and wildlife. Additionally, there were reports of birds dispersing waste to neighboring properties and increased truck traffic in the area.
In response to these issues, the CSRD had previously attempted to collaborate with the facility’s owners to rectify the non-compliance situation. However, according to the CSRD, these efforts have “yet to produce any results.” As part of their investigation, the CSRD was informed by the Ministry of Environment and Parks regarding the compost facility’s non-compliance with the provincial Organic Matter Recycling Regulations.
In an official letter sent on September 22, 2023, the CSRD detailed the ongoing issues faced by residents and the lack of effective action from the facility’s owners. The letter emphasized the need for decisive measures to ensure compliance, stating, “The scale and operation of the facility appears to unduly negatively impact the properties and residences in the neighbourhood,” as noted by planner Laura Gibson in a report presented to the board.
Next Steps in the Legal Process
With the legal process now underway, the CSRD has indicated it will refrain from further public comments regarding the case. Several residents have sought legal assistance from West Coast Environmental Law to address their grievances related to the compost facility. A local spokesperson acknowledged receipt of the CSRD’s letter but declined to comment further on the situation.
As the legal proceedings progress, the CSRD aims to bring the Spa Hills Compost facility into compliance with local bylaws, addressing the pressing concerns raised by the Silver Creek community. The outcome of this case could have significant implications for local environmental regulations and community health standards in the region.
