Costco Launches Urgent Lawsuit to Secure Tariff Refunds Amid Appeal
UPDATE: Costco has filed an urgent lawsuit against the U.S. government to protect its right to receive tariff refunds, should the U.S. Supreme Court reject President Donald Trump’s appeal for tariff authority. The complaint was lodged on November 5 in the U.S. Court of International Trade in Manhattan, highlighting the immediate financial implications for the retail giant.
The nation’s largest warehouse club operator, based in Issaquah, Washington, argues that Trump’s reliance on the International Emergency Economic Powers Act to impose tariffs has created uncertainty surrounding the potential refunds. Costco emphasized that U.S. Customs and Border Protection denied its request for additional time to finalize tariff calculations, jeopardizing its ability to claim funds it should not have paid.
This lawsuit comes as part of a wave of legal actions by numerous companies seeking to safeguard their financial interests amid ongoing tariff disputes. Other prominent firms involved include Bumble Bee Foods, EssilorLuxottica (maker of Ray-Ban eyewear), Kawasaki Motors, Revlon, and Yokohama Tire.
During the Supreme Court proceedings on November 5, justices raised critical questions about the legality of Trump’s use of the 1977 emergency powers law to enforce tariffs, reflecting a bipartisan skepticism. The Court is reviewing the case on an expedited schedule; however, no ruling date has been announced.
The stakes are high as Costco, which reported $275.2 billion in revenue for its fiscal year ending on August 31, seeks to mitigate the financial fallout from these tariffs. The company has already taken measures, such as reducing its supplier base and increasing local sourcing, to adapt to the changing trade landscape.
