Langley RCMP Sergeant Convicted of Assault on Shoplifting Suspect
UPDATE: A staff sergeant with the Langley RCMP has been convicted of assaulting a shoplifting suspect, marking a significant moment in police accountability. The ruling was issued by Justice John Gibb-Carsley on October 28, 2023, following an incident that took place on August 17, 2020.
This conviction stems from the assault of Dalibor Kuzmanovic, who was in custody at the detachment holding cells. The court relied heavily on video footage that contradicted the sergeant’s claims about the necessity of force used during the arrest.
On the night of the incident, Kuzmanovic was arrested at 8:40 PM after allegedly stealing items from a local Home Depot. Officers reported that he was cooperative but later questioned the need for a second search while being booked into custody. This led to a confrontation with S/Sgt. Damian Volk, who was supervising the booking process.
According to Gibb-Carsley’s ruling, Volk escalated the situation by physically subduing Kuzmanovic, claiming he felt threatened. The judge stated, “Volk’s subjective belief that he was in danger was not objectively reasonable.” This ruling highlights the importance of appropriate policing conduct and the need for accountability among law enforcement officials.
The judge emphasized that while policing can be challenging, “the resort to violence upon being questioned about an activity absent a reasonably believed threat should not be tolerated.” The court’s decision serves as a critical reminder of the standards expected from law enforcement personnel.
Constable Michael Dee, who was present during the incident, testified against Volk, expressing concerns over the use of excessive force. Gibb-Carsley commended Dee for his bravery in coming forward, stating that such actions are essential to prevent systemic issues within police forces.
This ruling not only impacts the individuals involved but also raises questions about police practices and the treatment of suspects. As communities call for greater transparency and accountability, this case underscores the ongoing dialogue around law enforcement conduct.
