Nevada Court Allows Jon Gruden’s Lawsuit Against NFL to Proceed

UPDATE: A Nevada court has just cleared the way for former Las Vegas Raiders coach Jon Gruden to proceed with his lawsuit against the NFL and Commissioner Roger Goodell, alleging a calculated effort to end his career through leaked emails. This significant ruling, made on October 2, 2023, allows Gruden to challenge the league’s actions that he claims were part of a “malicious and orchestrated campaign.”
Gruden’s lawsuit stems from a series of emails sent from 2011 to 2018 that included racist, misogynistic, and homophobic comments. He resigned from the Raiders in October 2021 following the public release of these damaging emails. The Nevada Supreme Court, in a 5-2 ruling, declared that the arbitration clause in the NFL Constitution is “unconscionable” and does not apply to Gruden as a former employee.
This ruling comes after the NFL attempted to dismiss the lawsuit and urged for out-of-court arbitration in 2022, which a Las Vegas judge previously rejected. The league’s failure to quash this lawsuit raises critical questions about the extent of their influence and actions regarding player and coach conduct.
Gruden is seeking monetary damages, claiming that the selective disclosure of his emails severely impacted his career and endorsement deals, particularly after their publication in major outlets such as the Wall Street Journal and New York Times.
Gruden’s history with the Raiders is notable; he previously coached the team from 1998 to 2001 before leading the Tampa Bay Buccaneers to a Super Bowl title in 2003. He returned to the Raiders in 2018 but has since been sidelined from coaching roles due to the fallout from the emails.
As news of this ruling spreads, the NFL has yet to publicly comment on the decision, while Gruden’s legal team remains silent on the next steps.
